Following a class-action annual-review bench-bar conference held remotely because of covid in November 2020, three teams of 44 volunteer lawyers were formed by the Center’s President to draft best practices addressing six issues identified at the conference.
The best practices are the first installment in the class-action compendium.
They address the following issues
- Hybrid bifurcated discovery approach
- Implementing 2015 Rule 23(e)(2) amendments, which collapse circuit-wide settlement factors into four core considerations
- Addressing objectively meritless objections to proposed class-action settlements
- Virtual appearances for court proceedings in class actions
- Considerations for effectively distributing settlement relief to class members
