Developing Optimal Proportionality EDiscovery Best Practices

The Center is developing best practices implementing an Optimal Proportionality Ediscovery Standard (OPES), which focuses on the significance of the requested discovery in resolving issues. A robust validation process provides the requesting party with the needed tools to assure itself of the discovery’s reliability. The OPES arises from the Center’s Ediscovery Bench-Bar Conference at the George Washington Law School in April 2023 and builds on the Center’s New Framework, continuing work refining the application of Rule 26(b)(1).
